Capture Amsterdam

Article 1. Applicability

1.1 These terms and conditions apply to all offers, orders, and agreements with Capture Amsterdam. These conditions are registered with the Chamber of Commerce in Amsterdam and will be sent free of charge upon request.

1.2 By placing an order with Capture Amsterdam, you agree to these terms and conditions.

1.3 All rights and claims stipulated in these conditions and any additional agreements also apply to intermediaries and third parties engaged by Capture Amsterdam.


Article 2. Prices and Payments

2.1 All prices are in euros, including VAT and shipping costs, unless otherwise stated or agreed in writing. Any import duties or customs fees are the responsibility of the customer.

2.2 Payment must be made via one of the payment methods offered during the ordering process: iDEAL, PayPal, or credit card.

2.3 If payment is not made on time or in full, Capture Amsterdam reserves the right to cancel the order.

2.4 If the price of a product increases between the time of ordering and delivery, the customer has the right to cancel the order within ten (10) days of being notified of the price increase.


Article 3. Delivery

3.1 The delivery times stated on the website are indicative. Capture Amsterdam aims to deliver orders within 7 to 10 business days, with a maximum delivery time of 30 days.

3.2 If delivery is not possible within 30 days, the customer has the right to cancel the agreement without additional costs.

3.3 Delivery is considered completed when the products have been offered at the specified delivery address.

3.4 Any damage during shipping must be reported to Capture Amsterdam within 48 hours of receipt.


Article 4. Retention of Ownership

4.1 Ownership of the products transfers to the customer only after full payment has been received. However, the risk of damage or loss transfers to the customer upon delivery.


Article 5. Intellectual Property

5.1 All intellectual property rights of Capture Amsterdam and its products remain with Capture Amsterdam or the original rights holders.

5.2 It is strictly prohibited to copy, reproduce, or publicly share photographs from Capture Amsterdam without prior written consent.

5.3 Photographers retain full copyright over their photographs.


Article 6. Complaints and Return Policy

6.1 Customers must inspect delivered products immediately upon receipt. Any defects must be reported in writing within two months of discovery.

6.2 If a product does not conform to the agreement, Capture Amsterdam will choose either to replace the item or issue a refund.

6.3 Personalized prints and custom frames are excluded from the right of withdrawal, unless there is a production defect.

6.4 Colors and sizes may differ from those displayed on computer screens.


Article 7. Communication and Liability

7.1 Capture Amsterdam is not liable for delays, miscommunication, or errors in orders caused by internet failures or other communication methods, unless there is intent or gross negligence.


Article 8. Privacy and Data Protection

8.1 Capture Amsterdam processes personal data in accordance with the General Data Protection Regulation (GDPR). Customers can refer to the privacy policy for details on how their data is collected and used.


Article 9. Force Majeure

9.1 In cases of force majeure, Capture Amsterdam has the right to suspend order execution or terminate the agreement without judicial intervention and without any right to compensation for the customer.


Article 10. Governing Law and Disputes

10.1 These terms and conditions are governed exclusively by Dutch law.

10.2 All disputes will be submitted to the competent court in the Netherlands.


Article 11. Liability and Warranty

11.1 Capture Amsterdam is only liable for direct damage up to a maximum amount equal to the value of the respective order. Indirect or consequential damages are excluded from liability.

11.2 Capture Amsterdam provides product warranties only to the extent granted by the original manufacturer.

11.3 Capture Amsterdam is not liable for damages resulting from improper use of products or for errors in prints processed by third parties.
